Private Client Update

This session will provide a review of current issues in Private Client Practice. The session will focus on good practice and avoiding pitfalls. The content will depend on developments over the Summer, in particular any tax changes announced by the new Government, but is likely to include:

  • Implications of the reduced CGT annual exemption: can trustees take steps to minimise CGT?
  • The changes to the income tax rules for low income trusts and estates: good or bad news?
  • Latest cases on BPR
  • A look at errors in  will drafting in recent cases including Pead v Prostate Cancer UK
  • Developments in relation to the Trust Register: the position on post-death variations

Working with the Residence Nil Rate Band

The Residence Nil Rate Band (RNRB) has been with us for some time now but there are a number of pitfalls. This session will provide a brush up on the legislation and highlight pitfalls and opportunities.  It will look particularly at problems in relation to trusts and the RNRB and deal with downsizing and how to calculate the allowance.

Inheritance (Provision for Family and Dependants) Act 1975

The 1975 Act presents problems for non-contentious practitioners both in relation to will drafting and the administration of an estate where a claim is either threatened or is taking place. Contentious practitioners have to be able to assess the strengths and weaknesses of a claim and to consider how costs are likely to affect clients.

This session will consider:

  • Recent decisions
  • How to assess the chances of success
  • How to minimise the chances of a claim succeeding when drafting a will
  • Conflict of interests
  • Progressing an administration when a claim is underway
  • The use of standstill agreements

Objectives

After completing the above course delegates will be and able to:

Update

  • aware of recent developments in the private client area
  • able to amend office practices appropriately.

RNRB

  • identify when the RNRB is available and whether it is possible to take steps to obtain it
  • identify whether or not a downsizing allowance is available and calculate it

Inheritance Act

  • evaluate the strength of a claim
  • advise PRs and beneficiaries on their roles
  • take steps to reduce the chances of a claim succeeding

Speaker Details

Professor Lesley King is a former member of the Probate & Estates Committee of STEP, a former member of the Law Society’s Wills & Equity Committee and an honorary member of the Association of Contentious Trust and Probate Specialists. She is Professional Development Consultant at the University of Law.

She is co-author of Wills, Taxation and Administration: A Practical Guide; A Modern Approach to Wills, Administration and Estate Planning (with Precedents); A Modern Approach to Lifetime Tax Planning for Private Clients (with Precedents); A Practitioner’s Guide to Wills; Varying the Disposition of an Estate after Death; Wills: A Practical Guide; and editor of The Probate Practitioner’s Handbook.

She is a contributor to the Wills and Trusts volumes of Halsbury’s Laws and the Encyclopaedia of Forms and Precedents and to The Law and Ethics of Dementia.

She is the wills and probate columnist for the Law Society Gazette, and writes and lectures extensively on wills, taxation and related matters.

  1. Sills & Betteridge LLP will send you confirmation of your booking by email or post within 2 days of receipt of this form.  A proforma will be sent to your accounts department. Once paid, you shall be sent a receipted VAT invoice.

The amount due on any proforma is payable in full within 30 days save that you may cancel a booking provided you give notice at least 10 working days’ prior to the date of the conference.  In such circumstances you will receive a full refund less an administration charge of £25.00 (plus VAT) per delegate.
  3. This booking form constitutes an offer and our confirmation to you constitutes an acceptance of a legally enforceable contract on these terms.  The delegate and employer shall be jointly and severally liable for payments of fees due under the contract.
Limitation of Liability
  1.
